1. Acceptance of terms
By creating an account and using Lumê (web platform at usalume.com.br), you agree to these Terms of Use and to the Lumê Privacy Policy. If you do not agree, do not use the platform.
2. About the service
Lumê is an AI beauty assistant focused on the Brazilian market. It offers:
- Skin, hair and color analysis from user-uploaded photos
- Cosmetic product scanner (label / INCI reading)
- Progress tracking over time
- Product and routine recommendations
- AI beauty chat (Premium plan)
- Monthly PDF reports (Pro and Premium plans)
Important: Lumê is a technology product and is not a medical, dermatological or cosmiatric service. The analyses and recommendations are informational and do not replace consultation with a qualified professional (dermatologist, esthetician, cosmetologist). See Section 9.
3. User account
- You must be at least 16 years old (EU) or 13 with a legal guardian (Brazil) to create an account. We recommend 18+ for full skin/hair tracking features.
- You are responsible for keeping your credentials confidential. Do not share your account.
- One account per person. Sharing a subscription across multiple people violates these terms.
- Information provided at registration must be truthful (name, email, CPF/CNPJ where applicable).
4. Plans and payments
4.1 Free plan
Free, no credit card required. Limited to:
- 1 skin analysis per month
- 1 hair analysis per month
- 1 color analysis per month
- 3 product scans per month
- History of recent analyses (no extended comparison)
4.2 Pro plan — R$ 29.90/month
Includes unlimited analyses, unlimited scanning, full progress tracking, monthly PDF report, priority in the processing queue, ad-free. Billed monthly via Asaas (Pix, card or boleto).
4.3 Premium plan — R$ 59.90/month
Everything in Pro plus unlimited AI Beauty Chat, deep analyses (high resolution), 12-month historical comparison, alerts for significant changes, and priority support.
4.4 Auto-renewal and cancellation
Paid plans auto-renew monthly. You can cancel at any time in Settings → Subscription. Cancellation takes effect at the end of the already-paid period — you keep the benefit until the end of the current month. No cancellation fees, no commitment.
4.5 Refunds
Pursuant to the Brazilian Consumer Defense Code (art. 49), you have a 7-day cooling-off period after subscribing if you have not yet consumed paid features. After that, or if you have used resources, refunds are evaluated case-by-case. Request via [email protected].
4.6 Price changes
Prices may be adjusted. We will notify at least 30 days in advance via app and email. If you don't agree, simply cancel before renewal.
5. Acceptable use
You agree not to:
- Upload photos of third parties without their explicit consent
- Upload illegal, offensive, pornographic, violent or rights-infringing content
- Reverse engineer, decompile, or extract the source code of the app
- Use the app to build datasets, train your own AI, or commercially compete with HPS Software using data extracted from Lumê
- Share credentials or accounts with others
- Use bots, scrapers, or unauthorized automation to interact with the app
- Intentionally overload the infrastructure (DDoS, mass requests, etc.)
Violation of the above may result in account suspension or termination without prior notice and without refund.
6. Intellectual property
- The name Lumê, logo, design and source code are property of HPS SOFTWARE LTDA.
- Your photos and analyses remain 100% yours — you grant us only the minimum, revocable license needed to process the analysis and provide the service.
- PDF reports generated by Lumê are for your personal use — you may share with your dermatologist or keep for yourself. Commercial reproduction (resale, attaching to third-party services) requires written permission.
7. AI-generated content
Analyses, recommendations and chat responses are generated by AI models (Anthropic Claude). Despite our effort to calibrate prompts and validate output, AI models may make mistakes, omit relevant information, or suggest products that aren't available in Brazil. Always use common sense, and for any real dermatological problem, consult a qualified professional.
We are not responsible for allergic reactions, irritations, or other consequences from using cosmetic products suggested by Lumê. Always patch-test new products, especially if you have a history of sensitivity.
8. Availability and support
We aim to keep Lumê available 24/7, but we do not guarantee uninterrupted availability. Planned maintenance will be announced in advance. Unexpected failures will be fixed as quickly as possible.
Priority support (Pro and Premium plans) responds within 24h on business days via email or WhatsApp. Free plan has email support with up to 5 business days response time.
9. Limitation of liability
Lumê is provided "as is" and "as available". To the maximum extent permitted by law:
- We do not provide medical, dermatological, aesthetic or any clinical diagnosis
- Product and routine recommendations are informational suggestions, not prescriptions
- You are solely responsible for testing products and evaluating your skin/hair reactions
- We are not responsible for allergic reactions, irritations, cosmetic or health consequences from using suggested products
- Our total liability, in any case, is limited to the amount you paid in the previous 12 months of subscription
This clause does not apply in cases of intent, fraud, or violation of basic consumer rights provided by the Brazilian Consumer Defense Code.
10. Termination
You may terminate your account at any time in Settings → Delete Account. HPS may terminate accounts in case of breach of these terms, fraudulent activity or legal requirement — with prior notice when possible.
After termination, your photos and analyses are deleted as described in our Privacy Policy. Rights and obligations already incurred (e.g., payment for the period used) remain in force.
11. Changes to terms
We may update these terms. Material changes (e.g., new price, new limit, new obligation) will be notified at least 30 days in advance via email and inside the app. Continued use after notification implies acceptance of the new terms. If you don't agree, simply close your account before the effective date.
12. Governing law and venue
These terms are governed by Brazilian law. In case of dispute, the venue of Passo Fundo / RS is elected, except where the Consumer Defense Code privileges the consumer's venue.
