Terms of Use.

1. Acceptance

By installing, running, or purchasing any content in the Kindled game, you acknowledge that you have read and accept these Terms of Use. If you disagree with any clause, uninstall the application.

HPS grants you a personal, non-transferable, non-exclusive, revocable license to install and run Kindled on personal devices, for entertainment purposes only. You may not:

• Redistribute, resell, rent, or loan the application;
• Decompile, reverse-engineer, or extract game assets;
• Use the game for commercial purposes (monetized streaming is permitted under standard fair-use);
• Modify the binary, cheat, or exploit bugs to gain unfair advantage on leaderboards or in purchases.

4. Age rating

Kindled is rated for players aged 12 and above. The game contains cartoon-style pixel violence and a dark fantasy theme. It does not include sexual content, profanity, real-money gambling, or illicit substances.

5. In-app purchases (IAP)

5.1 Processing

All purchases in Kindled are processed by the Apple App Store (iOS) or Google Play (Android). HPS does not process payments directly and does not store card or banking data.

5.2 Available products

• Coin Packs — bundles of in-game currency (consumables). E.g., "Ember Pouch" 1,500 coins, "Flamekeeper Chest" 5,000, "Warden Hoard" 15,000.
• Guardian Pass — one-time purchase. Permanently removes ads and unlocks all current and future episodes.
• Supporter Pack — one-time purchase. 5,000 coins + Crimson cosmetic skin + Amethyst torch.

5.3 Virtual currency

Coins purchased via IAP are usable exclusively within Kindled. They have no real-world monetary value, cannot be exchanged for cash, cannot be transferred between accounts, and cannot be refunded as cash. If you uninstall the app and lose the local save, accumulated coins are lost. Non-consumable purchases (Guardian Pass, Supporter Pack) can be restored via "Restore Purchases" using the same store account.

5.4 Refunds

Refund requests must be directed to the platform where the purchase was made (Apple or Google) and follow those platforms' policies. HPS may, at its discretion, intervene in exceptional cases but does not guarantee refunds outside the App Store / Google Play policies.

5.5 Taxes

Applicable taxes are collected according to local legislation and your store account configuration. HPS does not add taxes on top of the displayed prices.

6. Ads

Kindled may display optional rewarded ads (the player chooses to watch in exchange for an in-game benefit). Users with an active Guardian Pass will not see ads under any circumstance. See the Privacy Policy for details on advertising-identifier processing.

7. Accounts

Kindled does not require a standalone account. The Steam (PC) version authenticates via Steam and is additionally subject to the Steam Subscriber Agreement. Mobile versions link to your Apple / Google account only for purchase processing — we do not create or maintain a separate account database.

8. User-generated content

Kindled does not currently support user-generated content (UGC). If that functionality is ever added, these Terms will be updated.

9. Intellectual property

All code, pixel art, soundtrack, sound effects, the "Kindled" name, logo, script, and characters are property of HPS SOFTWARE LTDA or credited licensors (e.g., 0x72 — Dungeontileset II, and O-Lobster — Simple Dungeon Crawler — as listed in the app's About screen). Reproducing these assets outside the game requires written authorization.

10. Availability and changes

We intend to keep Kindled available indefinitely but reserve the right to modify, suspend, or discontinue the game, wholly or in part, at any time. In the event of discontinuation, we will make reasonable efforts to keep non-consumable purchases functional until the respective store removes the app.

11. Warranty and liability

The game is provided "as is". To the maximum extent permitted by law, HPS is not liable for loss of progress caused by uninstalling the app, device loss or change, platform failures (iOS / Android / Steam), or third-party service interruptions (AdMob, Sentry).

HPS's aggregate liability, under any circumstance, is limited to the amount you actually paid via in-app purchases in the 12 months preceding the event giving rise to the claim.

12. Termination

You may terminate this license at any time by uninstalling the app. HPS may terminate your license for material breach — particularly the misuse clause (section 3). Termination does not create a right to refund for virtual currency already purchased.

13. Privacy

Data processing is described in full in the Kindled Privacy Policy, which forms an integral part of these Terms.

15. Governing law

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of Passo Fundo — RS are elected as the jurisdiction for any disputes, except where applicable law (e.g., consumer-protection statutes) mandates a different forum in favor of the user.
